Published by Routledge in 2026 (672 p.), this collective volume is co-edited by six scholars, including Zohra Aziadé Zemirli (PhD in comparative law, former post-doctoral researcher at CEPED, Université Paris Cité/IRD), alongside Nathalie Bernard-Maugiron, Baudouin Dupret, Jean-Louis Halpérin, Radhika Kanchana and Ayang Utriza Yakin.

The book identifies 33 African and Asian countries where a plurality of personal statuses persists in family matters (often inherited from colonial configurations and articulated with Islam) and provides a comprehensive comparative overview of their legal systems. It examines the relationship between legal pluralism and the principle of equality at a time when these countries face growing tensions around such statuses. The approach is multidisciplinary (law, history, anthropology, sociology) and self-identifies with “socio-historical jurisprudence”.

The first part sets out the concepts in their historical, sociological, ethnographic and legal contexts. The remainder of the book gathers country-based or regional monographs written by international specialists. Zohra Aziadé Zemirli notably co-authors, with Nathalie Bernard-Maugiron, the chapter “Countries Falling Outside the Scope of the Research”, and with Jean-Louis Halpérin and Radhika Kanchana the chapter “From a Static Typology to a Typology of Dynamic Tensions”.

Le volume identifie 33 pays d’Afrique et d’Asie où subsiste une pluralité de statuts personnels en matière familiale (souvent hérités de configurations coloniales et articulés à l’islam) et en propose une vue d’ensemble comparée. Il examine la relation entre pluralisme juridique et principe d’égalité, à l’heure où ces pays connaissent des tensions croissantes autour de ces statuts. L’approche est multidisciplinaire (droit, histoire, anthropologie, sociologie) et se réclame d’une « jurisprudence socio-historique ».

La première partie pose les concepts en contexte historique, sociologique, ethnographique et juridique. Les parties suivantes offrent une monographie par pays ou groupe de pays voisins, rédigée par des spécialistes internationaux. Zohra Aziadé Zemirli y signe notamment, avec Nathalie Bernard-Maugiron, le chapitre « Countries Falling Outside the Scope of the Research », et avec Jean-Louis Halpérin et Radhika Kanchana le chapitre « From a Static Typology to a Typology of Dynamic Tensions ».

يرصد الكتاب 33 بلداً في أفريقيا وآسيا تتعايش فيها تعدّدية في قوانين الأحوال الشخصية للأسرة، وهي في الغالب موروثة عن التركيبات الاستعمارية ومتشابكة مع الإسلام، ويقدّم عرضاً مقارَناً شاملاً لأنظمتها القانونية. ويستقصي العلاقة بين التعدّدية القانونية ومبدأ المساواة، في لحظةٍ تشهد فيها هذه البلدان توتّرات متصاعدة حول تلك الأوضاع. والمقاربة متعدّدة الاختصاصات (القانون والتاريخ والأنثروبولوجيا وعلم الاجتماع)، وتنتسب صراحةً إلى «الاجتهاد القانوني السوسيو-تاريخي».

يُقدّم الجزء الأوّل المفاهيم في سياقاتها التاريخية والاجتماعية والإثنوغرافية والقانونية. أمّا الأجزاء التالية فتضمّ دراسات قُطرية أو إقليمية أعدّها أخصّائيون من مختلف أنحاء العالم. وتُشارك زهرة أزيادي زميرلي، إلى جانب ناتالي برنار-موجيرون، في تأليف الفصل المعنون «Countries Falling Outside the Scope of the Research»، كما تُشارك مع جان-لوي هالبيران وراديكا كانشانا في تأليف الفصل «From a Static Typology to a Typology of Dynamic Tensions».
