Contemporary Issues in Islamic Law, Economics and Finance
This book explores how Islam can impact the structures and performance of firms, financial institutions and capital markets across a range of countries and industries.
The Islamic finance industry represents an important reality not only because of the oil wealth of the Gulf states, which have fueled demand for such financial services, but also for an increased demand from a growing Muslim population in the West that aspires to express a full and all-inclusive religious identity. The increased demand for Muslim financial institutions has prompted Western non-Islamic firms to begin providing these services in an interesting effort of acculturation to the new plural scenario.
By adopting a multidisciplinary approach, which also takes into account the theological, legal and geopolitical framework, the book offers a comprehensive picture of Islamic financial tools, contracts and business opportunities. Drawing on different fields of expertise, it deals with various themes, such as the theological roots of Islamic economics and finance and its geopolitical impact; the EU policy of cooperation with MENA and GCC countries; the instruments of Islamic finance, its legal principle and ability to become an instrument for enhancing business opportunities; the functioning of Islamic banks; the development of capital markets within a financial model influenced by religious constraints and, finally, the new relationships of this religious financial system with Western legal systems. The book thus provides a complete and extensive overview of the practice of Islamic finance through the lenses offered by studies of economics and management.

Le secteur de la finance islamique représente un domaine important, non seulement en raison de la richesse pétrolière des États du Golfe, qui ont alimenté la demande de tels services financiers, mais aussi en raison d’une demande accrue de la part d’une population musulmane croissante en Occident, qui aspire à exprimer une identité religieuse complète et intégrale. La demande accrue d’institutions financières musulmanes a incité les entreprises occidentales non islamiques à commencer à fournir ces services dans un effort d’adaptation à la diversité religieuse.
En adoptant une approche multidisciplinaire, qui tient également compte du cadre théologique, juridique et géopolitique, cet ouvrage offre un tableau complet des outils, des moyens juridiques et des perspectives de la finance islamique. S’appuyant sur différents domaines d’expertise, il aborde divers thèmes tels que les racines théologiques de l’économie et de la finance islamiques ainsi que leur impact géopolitique ; la politique de coopération de l’UE avec les pays du Moyen Orient, de l’Afrique du Nord et du Conseil de Coopération du Golfe ; les instruments de la finance islamique, son principe juridique et sa capacité à devenir un instrument d’amélioration des opportunités commerciales ; le fonctionnement des banques islamiques ; le développement des marchés de capitaux au sein d’un modèle financier influencé par des contraintes religieuses et, enfin, les nouvelles relations de ce système financier religieux avec les systèmes juridiques occidentaux. L’ouvrage offre ainsi un panorama complet et détaillé de la pratique de la finance islamique à travers le prisme des études d’économie et de gestion.
Fournissant une analyse minutieuse et un cadre intégré des questions géo-économiques et politiques, l’ouvrage sera une ressource précieuse pour les universitaires, les chercheurs et les professionnels du commerce international, de l’entrepreneuriat et de la gestion des petites entreprises, du droit et de la religion et des études interculturelles.
