Drawn from her doctoral thesis, this book by Raja Sakrani (EB-Verlag, Bonner Islamstudien series, vol. 15, 2009, 321 pp.) examines the legal pluralism at work in the Tunisian Code of Obligations and Contracts. Starting from the synthesis crafted around 1900 by David Santillana, who brought Western legal rationality into dialogue with Arab-Islamic legal thought, the author shows how Islamic law was reinterpreted within European codification frameworks and appropriated by the scholars (ʿulamāʾ). A textbook case of the encounter of legal cultures, illuminating for the study of contemporary Islamic law.

Tiré de sa thèse de doctorat, cet ouvrage de Raja Sakrani (EB-Verlag, coll. Bonner Islamstudien, vol. 15, 2009, 321 p.) étudie le pluralisme juridique à l’œuvre dans le code tunisien des obligations et des contrats. À partir de la synthèse élaborée vers 1900 par David Santillana, qui fit dialoguer la rationalité juridique occidentale et la pensée juridique arabo-islamique, l’auteure montre comment le droit musulman a été réinterprété dans les cadres de la codification européenne et approprié par les savants (ʿulamāʾ). Un cas d’école de la rencontre des cultures de droit, éclairant pour l’étude du droit musulman contemporain.

مستمَدٌّ من أطروحتها للدكتوراه، يدرس هذا الكتاب لـرجا سكراني (منشورات EB-Verlag، سلسلة Bonner Islamstudien، المجلّد 15، 2009، 321 صفحة) التعدّديةَ القانونية في مجلّة الالتزامات والعقود التونسية. فانطلاقًا من التوليفة التي وضعها ديفيد سانتيلانا نحو عام 1900، والتي أجرت حوارًا بين العقلانية القانونية الغربية والفكر القانوني العربي-الإسلامي، تُبيّن المؤلِّفة كيف أُعيدت قراءةُ الفقه الإسلامي ضمن أطر التقنين الأوروبي واستوعبه العلماء. وهو نموذجٌ بارز للقاء الثقافات القانونية، ذو دلالةٍ لدراسة الفقه الإسلامي المعاصر.
