The Governance of Religious Freedom in Spain
Il governo della libertà religiosa in Spagna (Milan: Ledizioni, 2024), by Antonio Angelucci, examines the governance of religious freedom in Spain through the first twenty years of the Fundación Pluralismo y Convivencia, which since 2005 has promoted the positive freedom of minority religious confessions, including Muslim communities.
In light of the 1978 constitutional framework and the principles of religious freedom, non-discrimination, laicità and cooperation, the study reconstructs the Foundation’s work along two axes: scientific research on religious pluralism, and efforts to shape ecclesiastical policy and civil society. It identifies two open issues (the limited attention paid to non-religious convictions and the shortcomings of the system of Agreements with the force of law) and envisages moving beyond them towards a diffuse bilateralism and a dialogic form of laicità. The Foundation’s work is assessed positively, as a model for other legal systems grappling with contemporary religious pluralism.
Paru sous le titre Il governo della libertà religiosa in Spagna (Milan : Ledizioni, 2024), cet ouvrage d’Antonio Angelucci examine la gouvernance de la liberté religieuse en Espagne à travers les vingt premières années de la Fundación Pluralismo y Convivencia, qui promeut depuis 2005 la liberté positive des confessions religieuses minoritaires, dont les communautés musulmanes.
À la lumière du cadre constitutionnel de 1978 et des principes de liberté religieuse, de non-discrimination, de laïcité (laicità) et de coopération, l’étude reconstitue le travail de la Fondation selon deux axes : la recherche scientifique sur le pluralisme religieux, et l’action visant à orienter la politique ecclésiastique et la société civile. Elle identifie deux questions ouvertes (l’attention limitée portée aux convictions non religieuses et les insuffisances du système des Accords ayant force de loi) et envisage de les dépasser vers un bilatéralisme diffus et une forme dialogique de laïcité. Le travail de la Fondation est apprécié positivement, comme un modèle pour d’autres systèmes juridiques confrontés au pluralisme religieux contemporain.

يتناول حوكمة الحرية الدينية في إسبانيا من خلال العشرين عامًا الأولى من عمر مؤسسة التعددية والتعايش، التي تعمل منذ عام 2005 على تعزيز الحرية الإيجابية للطوائف الدينية الأقلية، ومن بينها الجماعات المسلمة.
وفي ضوء الإطار الدستوري لعام 1978 ومبادئ الحرية الدينية وعدم التمييز والعلمانية والتعاون، تعيد الدراسة بناء عمل المؤسسة وفق محورين: البحث العلمي في التعددية الدينية، والسعي إلى التأثير في السياسة الكنسية والمجتمع المدني. وتحدد الدراسة مسألتين مفتوحتين (الاهتمام المحدود بالقناعات غير الدينية، وأوجه القصور في نظام الاتفاقيات ذات قوة القانون)، وتتصور تجاوزهما نحو ثنائية منتشرة وشكل حواري من العلمانية. ويُقيّم عمل المؤسسة إيجابيًا، بوصفه نموذجًا لأنظمة قانونية أخرى تواجه التعددية الدينية المعاصرة.
