Is God a Lawgiver? Christian and Muslim Perspectives on Ius divinum

Law that invokes divine appointment or other religious justifications is repeatedly the focus of general attention in Germany. Beyond the concrete religious legal provisions, there is a reflection on divine law in the Christian and Islamic traditions that certainly has commonalities.
This volume explores central questions – such as the relationship between revelation and law, the changeability and context-dependency of divine law or the relationship between natural law and divine law.

Le droit, qui se fonde sur la volonté divine ou d’autres motifs religieux, est toujours au centre de l’attention en Allemagne. Au-delà de la législation religieuse concrète, il y a une réflexion sur le droit divin dans les traditions chrétiennes et islamiques, qui ont des points communs. Ce volume traite de questions centrales – telles que la relation entre la Révélation et le droit, la convertibilité et la dépendance contextuelle du droit divin, ou la relation entre le droit naturel et le droit divin.

لطالما شكّل القانون القائم على الإرادة الإلهية أو غيرها من الأسس الدينيّة، موضع الاهتمام في ألمانيا. فما بعد التشريع الديني الملموس، يكمنُ تأمّل معمّق بالقانون الإلهي في التقاليد المسيحية والإسلامية التي تجمعها نقاط مشتركة. يتناول هذا المجلّد المسائل المركزية – مثل العلاقة بين الوحي والقانون، وقابلية تحويل القانون الإلهي وتبعيته السياقية، أو العلاقة بين الحقّ الطبيعي والقانون الإلهي.
